1. Who We Are
ZeitPass (“ZeitPass”, “we”, “our”, “us”) is a digital platform and content service operated by:

2. Scope of These Terms
These Terms of Use (“Terms”) govern your access to and use of all ZeitPass services, including:

The ZeitPass website at zeitpass.com and all associated pages and subdomains.

The Munich Shortlist, a free weekly email newsletter curating experiences in Munich.

The ZeitPass User Portal, a members-only platform, which is governed additionally by the ZeitPass Membership Terms available at zeitpass.com/membership-terms.
By visiting the website, subscribing to any ZeitPass service, or submitting information through any ZeitPass form, you confirm that you have read and agreed to these Terms. If you do not agree, you must not use any ZeitPass service.
3. The Munich Shortlist Newsletter
3.1 Description
The Munich Shortlist is a free weekly email newsletter published by ZeitPass. Each edition contains a curated selection of experiences, events, and activities in Munich, published every Friday morning. ZeitPass reserves the right to change the publication schedule, format, or content at any time without prior notice.
3.2 Editorial Independence
The Munich Shortlist operates on a fully independent editorial basis. ZeitPass does not accept payment, sponsorship, commission, or any form of commercial consideration from venues, event organisers, or experience providers in exchange for inclusion. All recommendations are made at the sole discretion of ZeitPass, based on quality, relevance, and suitability for the audience.
3.3 No Booking or Transaction Services
The Munich Shortlist is an editorial curation service only. ZeitPass does not facilitate bookings, ticket purchases, or financial transactions through the newsletter. Any booking or participation in a listed experience is made directly between the reader and the third-party provider. ZeitPass is not a party to any such transaction and accepts no liability arising from it.
3.4 Accuracy of Content
ZeitPass takes reasonable care to ensure the accuracy of published information. However, event details including dates, times, prices, and availability are subject to change without notice and must be verified directly with the provider before attendance. ZeitPass does not warrant that all content is complete, current, or error-free.
4. The ZeitPass User Portal
The ZeitPass User Portal is a members-only platform available exclusively to paid ZeitPass subscribers. Access to the Portal and all associated services, including event curation, booking facilitation, and membership management, is governed by the ZeitPass Membership Terms, which form a separate agreement between ZeitPass and each member.
The ZeitPass Membership Terms are available at zeitpass.com/membership-terms. By registering for a membership plan, you agree to be bound by both these Terms of Use and the Membership Terms.
5. Intellectual Property
All ZeitPass content, including but not limited to newsletter editions, website copy, brand name, logo, visual identity, editorial selections, and any original written or visual material, is the exclusive intellectual property of ZeitPass UG (haftungsbeschränkt).
You may not copy, reproduce, republish, distribute, sell, or otherwise exploit any ZeitPass content without prior written permission. Personal, non-commercial sharing of individual newsletter recommendations is permitted, provided ZeitPass is clearly attributed as the source.
6. Acceptable Use
By using any ZeitPass service, you agree that you will not:

Use ZeitPass content for commercial purposes without prior written authorisation.

Reproduce, scrape, or systematically extract content from the newsletter or website.

Impersonate ZeitPass, its directors, or any ZeitPass representative.

Use ZeitPass services in any manner that violates applicable German or EU law.

Attempt to gain unauthorised access to any ZeitPass systems, accounts, or infrastructure.

Submit false, misleading, or fraudulent information through any ZeitPass form or channel.
ZeitPass reserves the right to suspend or terminate access to any user found to be in breach of these Terms, without notice and without liability.
7. Limitation of Liability
ZeitPass provides its services on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, ZeitPass excludes all liability for:

Any inaccuracy in newsletter or website content, including event details, dates, prices, or availability.

Your participation in any third-party experience, event, or activity featured or recommended by ZeitPass.

Any interruption, suspension, or discontinuation of any ZeitPass service.

Any indirect, incidental, or consequential loss arising from your use of ZeitPass services.
Vendor non-performance: ZeitPass acts as a curator and facilitator only. The contractual relationship for any experience or event is between you and the third-party vendor or provider. ZeitPass is not liable for the failure of any vendor to deliver a booked experience, for cancellations by the vendor, or for the quality of any experience provided.
Nothing in these Terms excludes or limits liability for death or personal injury caused by ZeitPass’s negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable German law.
8. Privacy
The collection and processing of your personal data is described in full in the ZeitPass Privacy Policy, available at zeitpass.com/privacy-policy. By using any ZeitPass service, you acknowledge that you have read the Privacy Policy.
9. Changes to These Terms
ZeitPass reserves the right to update these Terms at any time. The current version is always available at zeitpass.com/terms. Where changes are material, ZeitPass will notify active subscribers by email at least 14 days before the changes take effect. Continued use of any ZeitPass service after the effective date constitutes acceptance of the updated Terms.
10. Governing Law and Jurisdiction
These Terms are governed exclusively by the laws of the Federal Republic of Germany. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Munich, Germany. If you are a consumer residing in the European Union, you retain the benefit of any mandatory consumer protection provisions applicable in your country of residence that cannot be waived by contract.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
